In short

  • You must be 18 or older. Joining is free; AI work runs on prepaid credits.
  • Velvet Engine doesn’t pay customers: there are no payouts, revenue shares or commissions.
  • Store products are sold by Velvet Engine, and the money from store sales is Velvet Engine’s.
  • You own what you upload and, as far as the law allows, what your workspace makes. You license it to us to run the service.
  • Every persona is labeled as an AI character, and the labels stay on.

01This agreement

These terms are an agreement between you and Velvet Engine (“we” or “us”). They cover the Velvet Engine website and app, autopilot, AI creators’ store pages, the Movies studio and everything else we offer under the Velvet Engine name (together, the “service”).

The Acceptable Use Policy and the Credits and Refunds Policy are part of these terms. The Privacy Policy explains how we handle personal data.

By creating an account or using the service, you accept these terms. If you use the service for a company or other organization, you confirm that you may accept these terms for it, and “you” includes that organization.

02Accounts

  • You must be 18 or older to create an account or use the service.
  • Give accurate details when you sign up and keep your password safe. You’re responsible for what happens under your account, so tell us straight away if you think someone else is using it.
  • Work happens in workspaces. The people you invite to a workspace can see and act on its content according to their role, and you’re responsible for who you invite.
  • Sign-ups may be by invitation only at times. We also run a demo account with sample data; it never generates or posts anything.

03What the service does

You describe an AI influencer, which we call an AI creator or persona. Autopilot builds the persona, makes short videos every day, posts them to the persona’s Instagram, TikTok and YouTube accounts, answers comments and DMs with AI, and runs a store that sells digital products. The Movies studio makes AI short films.

The service relies on AI models and on other companies’ platforms, so:

  • AI output can be wrong or unsuitable. Our compliance checks catch a lot, but not everything. You can choose to approve posts and products before they go out, and you should review what your creators publish.
  • We don’t promise views, followers, reach, sales or any other result.
  • Instagram, TikTok, YouTube and our providers can change their rules, features or prices, limit an account or remove content. We aren’t responsible for their decisions, and we may have to change the service when they change.

04AI labels

Every persona is presented as an AI character. Each bio says the persona is an AI character, each post sets the platform’s AI-content flag, and automated DMs say so in the first message. A persona made from an AI twin says in its bio that it’s the AI twin of a real person.

These labels are part of the service, not a setting. Don’t remove, hide or contradict them, and don’t present a persona as a real human.

05Social accounts, persona email and saved logins

  • You link each persona’s Instagram, TikTok and YouTube accounts from the app. We connect to them through Zernio, our publishing provider. Linking an account lets us use it for you: to post, to read and answer comments and DMs, and to read analytics.
  • You’re responsible for those accounts and for following each platform’s terms. You can unlink an account at any time; autopilot then stops posting and replying there.
  • Each persona gets an email address on our domain (for example, mila@velvetengine.ai) so it can sign up for its accounts. We receive and store mail sent to it, so sign-up codes show in the app. Use it only for the persona’s own accounts.
  • You can save the passwords for a persona’s accounts in the app. We store them encrypted, only members of your workspace can reveal them, and every reveal is logged.

06AI twins

You can turn yourself, and only yourself, into an AI twin. You must be 18 or older, take a live selfie, give spoken consent, and provide reference photos and a voice recording that show only you.

  • You choose whether only you or everyone in your workspace can use your twin.
  • You can revoke your likeness at any time on the Likeness page. We then delete your twin’s photos, recording, reference images and cloned voice, and the personas that use it stop: they’re paused and their copies of your face and voice are deleted.
  • Content already made with your twin stays in the workspace unless you ask for it to be removed.
  • Never use the service to make an AI version of anyone else.

The Privacy Policy explains how we handle face and voice data.

07Credits and payment

Joining is free. AI work, such as building a creator, making videos, writing replies, creating store products, AI twins and films, is paid for with prepaid credits.

  • You buy credits by card through Stripe Checkout. Card details go to Stripe, never to us.
  • We set what a credit is worth. Right now, 100 credits cost $1. We may change the price of credits and of AI actions, and every AI action shows its price in credits before it runs.
  • Credits don’t expire while your account is open. They have no cash value and can’t be transferred or exchanged for money.
  • When your balance reaches zero, AI work pauses until you add credits. A job that’s already running finishes even if it takes your balance slightly below zero, and your next purchase covers that first.
  • You can set a monthly spending limit. Autopilot stops at the limit, even with credits left.
  • We may grant credits, such as welcome credits.
  • Refunds follow the Credits and Refunds Policy. A refund takes the matching credits back out of your balance.

08The store

Each AI creator can have a store that sells digital products, such as PDF guides, workbooks and planners. Autopilot drafts the products. Depending on your review mode, they go live on their own or after someone in your workspace approves them.

  • Velvet Engine is the seller. Store products are sold by Velvet Engine through its own Stripe account. Buyers buy from Velvet Engine, not from you.
  • Store sales belong to Velvet Engine. The money from every sale is Velvet Engine’s, and you have no claim to it. Sales don’t add credits to your balance and aren’t paid out to you.
  • We handle checkout, delivery, buyer support and refunds for store orders.
  • Buyers’ details are Velvet Engine’s customer data. Your workspace shows orders so you can see what sells and resend a download link. Don’t use buyers’ details for anything else.
  • You can archive a product to take it off sale. We may refuse or remove any product, or change its price or listing, for example to follow the law or Stripe’s rules.

09Your content

You own what you upload. As far as the law allows, you also own the content made in your workspace: personas, scripts, images, videos, voices, products and films.

You give Velvet Engine a worldwide, non-exclusive, royalty-free license to host, copy, process, adapt, generate from and publish that content to run the service, and to sell the store products your creators make, with Velvet Engine keeping the proceeds. The license lasts while the content is in the service, and after that only as long as we need it to fulfil and support orders already made, keep required records and meet legal obligations.

  • You’re responsible for having the rights to everything you upload, such as photos, brand material and product details.
  • In some countries AI output can’t be protected by copyright, and other users may get similar output. We don’t promise that what the service makes is unique or can be registered.
  • Posts published on Instagram, TikTok and YouTube are also covered by those platforms’ terms.

10Rules and enforcement

Follow the Acceptable Use Policy. In short: keep AI labels on, don’t impersonate real people, make a twin only of yourself, follow each platform’s rules and disclose ads, and don’t make deceptive or harmful content or anything involving minors.

Our compliance gate checks scripts, captions, products and DMs before they’re used, and can flag or block them. We may also review content, remove it, take products off sale, revoke a likeness, pause autopilot or suspend a workspace if we believe these terms or the law are being broken, or to protect people, the platforms we post to or the service.

11Other companies’ services

The service runs on other companies’ services, including AI model providers, Zernio for posting, Stripe for payments and Resend for email; the Privacy Policy lists them. Their availability and rules affect the service, and a feature can stop working if a provider changes or ends what it offers. When you link a social account, you also deal with that platform under its own terms.

12Suspension and closing your account

  • You can stop using the service at any time. To close your account or a workspace, contact us.
  • Our platform admins can suspend a workspace. While it’s suspended, autopilot doesn’t plan, make, post or reply there.
  • We may suspend or close an account that breaks these terms or the law.
  • When an account is closed, its unused credits end with it, unless a refund is due under the Credits and Refunds Policy or the law.
  • Terms that by their nature should last, such as ownership, the license for orders already made, payment, disclaimers and limits on liability, continue after an account is closed.

13Changes

The service changes often. We may add, change or remove features, AI models and providers. We may also update these terms; the date at the top shows the latest version. If a change matters, we’ll tell you in the app or by email before it applies. If you keep using the service after a change applies, you accept the updated terms.

14Disclaimers and liability

Disclaimers

We provide the service “as is” and “as available”. As far as the law allows, we disclaim all warranties not written in these terms, including merchantability, fitness for a particular purpose and non-infringement. Content made with AI isn’t professional advice, whether medical, legal, financial or otherwise.

Limits on liability

As far as the law allows, Velvet Engine isn’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, followers or goodwill. Our total liability for all claims about the service is limited to what you paid us for credits in the 12 months before the event the claim is about.

Nothing in these terms limits liability that the law doesn’t allow us to limit.

Claims about your content

If someone makes a claim against Velvet Engine because of content you uploaded or directed, a likeness you provided, your social accounts, or your breach of these terms or the law, you’ll cover our reasonable costs and losses from that claim, including reasonable legal fees. We’ll tell you about the claim and let you take part in the defense.

15Governing law

These terms are governed by the laws of the place where Velvet Engine is established, without regard to conflict-of-law rules.

If you’re a consumer, you keep the protection of the mandatory laws of the country where you live; nothing in these terms takes that away.

If something goes wrong, please contact us first. Most problems can be solved without a formal dispute.
